Refund Policy

PictureBoss hosting is non refundable, we offer a 14 day free trial, please make sure you are satisfied with the product prior to purchase.

Terms of Service

PictureBoss provides high quality World Wide Web page hosting, and as such we will endeavour to meet your needs in the best ways possible.

PictureBoss will act with the highest integrity and try to avoid having to enforce the following Terms Of Service unless no reasonable solution can be agreed upon buy both parties. It is PictureBoss's policy to first try and resolve any issues on a case by case basis with you, our client, by discussion and openness. These Terms Of Service are only in place to protect you and PictureBoss from today's litigious society.

PictureBoss reserves the right to suspend or cancel a customer's access to any or all services provided by PictureBoss when PictureBoss decides that the account has been inappropriately used or otherwise and no reasonable solution can be agreed upon buy both parties.

Server Use

PictureBoss does not allow any of the following content to be stored on its servers:

• Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.
• Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of PictureBoss.
• Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.
• Hate Sites - Including defamatory or discriminatory sites.
• Spamming - no "unsolicited e-mail" or 'SPAM' may be sent from any PictureBoss server.That is, any electronic mail sent to a given list of address(es) for which the owner(s) have not given permission, express or otherwise, for the Customer's use in mass communication.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold PictureBoss harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against PictureBoss, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless PictureBoss against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with any PictureBoss server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from any PictureBoss server.

PictureBoss will not be responsible for any damages your business may suffer. PictureBoss makes no warranties of any kind, expressed or implied for services we provide. PictureBoss disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non deliveries, wrong delivery, and any and all service interruptions caused by PictureBoss and its employees. PictureBoss reserves the right to revise its policies at any time.
